What does Du Kang have to do with wine?

At the end of the Eastern Han Dynasty, "You should be generous and unforgettable. How to solve your worries? Only Du Kang. " Now, Du Kang drinks rather than drinks. Being trapped in a trademark increases your worries. Relieve your worries? Du Kang said it was impossible!

The dispute over Du Kang trademark between Baishui Du Kang in Shaanxi and Du Kang in Luoyang, Henan Province is a historical issue. According to legend, the three brothers Dukang were making wine at that time: the boss was making Dukang wine in Shaanxi; The second child went to Shanxi to make wine, but the wine was not made, so he made a Shanxi mature vinegar; Sanzi went to Yichuan County, Luoyang to make Dukang wine, thus forming a Dukang dispute between Luoyang and Henan. There are also rumors that three descendants of Du Kang sold Dukang wine in different places, and then the two merged, leaving Du Kang in Yichuan County of Luoyang and Du Kang in Baishui, Shaanxi Province.

In a word, the two Dukang wine lawsuits have been fought for 30 years, and they are also arguing endlessly. From the State Administration for Industry and Commerce to the Trademark Office, from the Trademark Office to the Trademark Arbitration Commission, to Beijing No.1 Intermediate People's Court, to Beijing High Court and finally to the Supreme People's Procuratorate. The final result of the court ruling is: each uses its own.

In other words, the current Du Kang trademark is equivalent to two brands. The two companies also registered their own trademarks. Figure 1 Figure 2 shows the trademark retrieved by Master Quan. Figure 1 is the trademark of "Du Kang" registered by Du Kang Winery in Yichuan County on 1980, and was approved for registration on 198 1. Figure 2 shows "Baishui Dukang" registered by Shaanxi Baishui in 1995 and its trademark, which was approved for registration in 1996.

Xiao Er noticed that last month, the trademark wars between two Du Kang companies had a new move, and there was a resurgence.

Du Kang, Baishui County, Shaanxi Province sued Du Kang, Yichuan County, Luoyang for business slander.

Because Du Kang in Yichuan County, Luoyang printed the slogan "sole holder of Du Kang trademark" on the product packaging, Shaanxi Baishui Du Kang sued and won the case, and sentenced Du Kang in Yichuan County, Luoyang to immediately destroy or replace the existing product packaging that printed the slogan, and published a newspaper to eliminate the influence and compensate Shaanxi Baishui Du Kang Liquor Industry for 500,000 yuan.

Du Kang of Yichuan County sued Du Kang of Baishui County, Shaanxi Province for trademark infringement and won the case.

Shaanxi Baishui changed the trademark pattern on the bottle body and outer packaging of its products. The word "Du Kang" is highlighted and the word "white water" is weakened on both the bottle packaging and the outer packaging of wine boxes, and the word "white water" is arranged above and below the word "spring", which makes the product logo only slightly different in font and text arrangement. Du Kang, Yichuan County, Luoyang filed a lawsuit. The first instance ruled that Baishui Du Kang's behavior constituted trademark infringement, and compensated Luoyang Du Kang for 6.5438+0.5 million yuan.

In the same month, the litigation and judgment results of both parties were quite different, which made people feel somewhat intriguing. In the final analysis, these opportunistic behaviors in product packaging are because they want to take advantage of the influence of Du Kang trademarks to gain greater market share.

Therefore, the value of trademarks has been squeezed by two wine industries. The word "squeezing" is used because the trademark dispute that lasted for many years occupied a lot of energy on both sides and even overdrawn. The 30-year-long trademark tug-of-war in Du Kang made both sides pay little attention to the protection of Du Kang's trademark, which seriously reduced the market value of Du Kang's trademark, and Du Kang also lost the gold-lettered signboard of "Time-honored Brand of China" issued by the Ministry of Commerce. Two Du Kang wine companies are fighting for trademarks in China. In the eyes of consumers, Du Kang trademark has been unable to move forward at the level of high-end market, and has almost stopped creating innovative wine.

Over time, the biggest problem faced by these two Du Kang wine industries is not only the compromise of trademarks, but also the slow development of the wine industry for so many years, making it difficult to regain the gradually lost market share. In the future, the challenges encountered by these two wine industries will only be greater and more difficult to break through!
