Regulations of Shaanxi Province on Meteorological Disaster Prevention
Meteorological disasters as mentioned in these Regulations refer to disasters caused by drought, lightning, rainstorm (snow), strong wind, fog, high temperature, hail, sandstorm, continuous rain, frost, low temperature, freezing rain, freezing, cold wave and haze. Article 3 The prevention of meteorological disasters shall follow the principles of overall planning, graded responsibility, giving priority to prevention and combining prevention with control. Article 4 The people's governments at or above the county level shall strengthen the organization and leadership of meteorological disaster prevention work, establish and improve the coordination mechanism of meteorological disaster prevention work, incorporate meteorological disaster prevention work into the national economic and social development plan at the corresponding level, and incorporate the required funds into the fiscal budget at the corresponding level. Article 5 The competent meteorological departments at or above the county level shall be responsible for monitoring, forecasting and early warning of disastrous weather, climate feasibility demonstration, weather modification and lightning protection within their respective administrative areas, and organize meteorological stations (stations) to carry out climate change analysis and climate impact assessment.
The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in meteorological disaster prevention. Article 6 People's governments at or above the county level shall organize competent meteorological departments and relevant departments to publicize meteorological disaster prevention laws and regulations to the society, popularize meteorological disaster prevention knowledge, enhance the public's awareness of meteorological disaster prevention, organize emergency drills according to actual needs, and improve the emergency capabilities of hedging, disaster avoidance, self-help and mutual rescue.
Units and individuals shall assist the local people's governments to publicize meteorological disaster prevention knowledge and carry out meteorological disaster emergency drills. Seventh people's governments at or above the county level and their relevant departments and competent meteorological departments shall commend and reward the units and individuals that have made outstanding contributions in the prevention of meteorological disasters. Chapter II Preventive Measures and Protection of Facilities Article 8 The people's governments at or above the county level shall organize the competent meteorological departments and relevant departments to carry out general surveys of meteorological disasters, establish a basic database of meteorological disasters, delimit the risk areas of meteorological disasters, and formulate meteorological disaster prevention plans in their respective administrative areas according to the meteorological disaster prevention plans of the people's governments at the next higher level, taking into account the characteristics of local meteorological disasters and the results of risk assessment. Ninth meteorological disaster prevention planning should include the occurrence, development and present situation of meteorological disasters, defense principles and objectives, prone areas and prone periods, construction and management of defense facilities, defense measures and so on. Article 10 People's governments at or above the county level shall, according to the meteorological disaster prevention plan, organize competent meteorological departments and relevant departments to formulate emergency plans for meteorological disaster prevention in their respective administrative areas and report them to the people's government at the next higher level for the record.
The competent meteorological departments and relevant departments shall, according to the meteorological disaster prevention plan and emergency plan of the people's government at the corresponding level, formulate their own emergency plans for meteorological disaster prevention, and report them to the competent department at the next higher level and the people's government at the corresponding level for the record.
Industries or units susceptible to meteorological disasters shall formulate corresponding emergency plans for meteorological disaster prevention according to actual conditions. Eleventh meteorological disaster emergency plan should include emergency plan start-up standards, emergency organization and command system and responsibilities, prevention and early warning mechanism, emergency measures and safeguard measures. Twelfth counties (cities, districts) and Township People's governments set up comprehensive emergency rescue teams, as well as professional emergency rescue teams of relevant departments at or above the county level, to undertake the rescue work of meteorological disasters. Thirteenth provincial meteorological authorities according to the characteristics and distribution of meteorological disasters in the province, the overall allocation of meteorological technology and equipment in the province, to ensure supply.
The competent meteorological departments at or above the county level shall establish meteorological communication and data transmission channels to ensure smooth emergency channels. Fourteenth people's governments at all levels should incorporate meteorological disaster prevention, monitoring and information dissemination into urban and rural planning. No unit or individual may occupy, destroy or move meteorological disaster prevention facilities without authorization.
New construction, expansion and reconstruction projects should avoid affecting meteorological disaster prevention facilities; If it is really unavoidable, the construction unit shall obtain the consent of the facility management institution in advance and take corresponding measures before construction.
When meteorological disaster prevention facilities are damaged due to force majeure, the facility management institution shall immediately repair them to ensure the normal operation of the facilities. Fifteenth people's governments at all levels, relevant departments and units shall, according to the characteristics of local meteorological disasters and risk assessment results, organize the construction of water conservancy and drought relief projects, flood control facilities, emergency shelters, dredging rivers and urban drainage networks. To ensure the safety and smoothness of water, electricity, gas and warm traffic roads and communication lines under bad weather conditions, and improve the ability to prevent meteorological disasters.
Under severe weather conditions such as rainstorm (snow), fog and freezing, people's governments at all levels and relevant departments of public security, transportation and municipal administration shall organize drainage, snow removal and traffic guidance to ensure the safety of people's lives and property. Sixteenth competent meteorological departments at or above the county level shall strengthen the management of lightning disaster prevention, improve the level of lightning disaster monitoring and forecasting, and do a good job in the qualification management of professional design, construction and testing units of lightning safety protection devices.
When the newly built, rebuilt and expanded buildings (structures) are completed and accepted, the lightning protection devices shall be accepted at the same time, and the competent meteorological departments shall participate. Where lightning protection devices need to be installed separately in mining areas, tourist attractions or buildings (structures) and facilities put into use in lightning-prone areas, the competent meteorological departments at or above the county level shall be responsible for the completion and acceptance of lightning protection devices.
