Units and individuals shall actively participate in voluntary blood donation activities.
Encourage national staff, active servicemen and college students to take the lead in donating blood. Fourth provinces, cities and counties (including county-level cities and districts, the same below) health administrative departments are responsible for the supervision and management of blood donation within their respective administrative areas.
The people's governments of cities and counties shall set up voluntary blood donation offices in the administrative departments of health, and be responsible for the daily work of blood donation within their respective administrative areas. Fifth people's governments at all levels should widely publicize the significance of blood donation, popularize scientific knowledge of blood donation, and carry out education on prevention and control of blood-borne diseases.
The news media should publicize blood donation for public welfare. Schools should educate students in blood science. Sixth annual blood donation plan management. State organs, social organizations, armed forces, enterprises and institutions (hereinafter referred to as units), residents' committees and villagers' committees shall, according to the blood donation plan, mobilize and organize healthy citizens of their own units or their local areas to participate in blood donation, so as to ensure the completion of the annual blood donation plan. Article 7 The annual blood donation plan shall be compiled by the voluntary blood donation office and issued after being approved by the people's government at the same level. Eighth units that have completed the annual blood donation plan shall be issued a certificate of completion of the annual blood donation plan by the administrative department of health.
Those who have exceeded the blood donation plan for two consecutive years shall be commended by the people's government at the corresponding level and the Red Cross. Ninth citizens donate blood for free, and the blood donation office will issue a blood donation certificate uniformly made by the health administrative department of the State Council, and the relevant units can give appropriate subsidies. Tenth it is forbidden to use, borrow or rent another person's blood donation card. Eleventh blood donors enjoy the following benefits:
(a) free use of blood within 5 years from the date of blood donation, and free use of the same amount of blood after 5 years;
(two) the cumulative blood donation of more than 800 ml, rewarded by the Municipal People's government and the Red Cross, and free blood for life.
Spouses and immediate family members of blood donors shall use the same amount of blood free of charge within 5 years after 3 months from the date of blood donation. The amount of blood used for blood donation exceeds their amount, and only the fees for blood collection, storage, separation and inspection are charged. Article 12 Citizens' blood donation shall be collected by blood stations (including blood stations, central blood stations, grass-roots blood stations or central blood banks, the same below) established according to law and obtained blood collection and supply licenses. Article 13 Before collecting blood, a blood station must conduct necessary health examination for blood donors free of charge. No blood shall be collected from persons who do not meet the health examination standards prescribed by the state. Fourteenth blood stations must strictly abide by the relevant technical norms and systems. Blood collection personnel must undergo professional and technical training. The equipment used for blood collection must be disposable articles in line with national regulations, and must be disposed of according to regulations after use. The collected blood must be re-examined, and its packaging, storage and transportation must comply with state regulations. Article 15 Blood for clinical use in medical institutions must be collected from blood stations designated by health administrative departments.
In any of the following circumstances, the medical institution designated by the provincial health administrative department may temporarily collect blood:
(a) due to force majeure, the blood supply in the blood station is insufficient;
(2) Medical institutions in inaccessible areas are in urgent need of blood. Sixteenth provincial health administrative departments can adjust the blood volume of blood stations according to the clinical use of blood in various cities. Article 17 Anyone who fraudulently uses, borrows or rents another person's blood donation card shall be given a warning by the administrative department of health according to the seriousness of the case, and shall be fined at least 654.38 million yuan but not more than 654.38 million yuan per case. Article 18 Where a blood station collects blood in violation of relevant operating rules and regulations, the health administrative department shall order it to make corrections; Damage to the health of blood donors shall be compensated according to law, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Nineteenth blood stations in violation of regulations, to provide medical institutions with blood that does not meet the standards prescribed by the state, the health administrative department shall order it to make corrections; If the circumstances are serious, resulting in the spread of blood-borne diseases or serious risk of spread, rectification shall be made within a time limit, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Twentieth medical personnel in medical institutions in violation of regulations, for patients who do not meet the national standards, the health administrative department shall order them to correct; Damage to the health of patients, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Twenty-first health administrative departments and blood donation office staff dereliction of duty in the supervision and management, resulting in serious consequences, does not constitute a crime, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
