Development and reform, finance, economy and information technology, public security, agriculture and animal husbandry, forestry, water conservancy, environmental protection, civil aviation and other departments are responsible for weather modification according to their respective legal responsibilities. Article 6 The competent meteorological departments at or above the county (city) level shall organize research on weather modification for disaster prevention and mitigation, coping with climate change, protecting the ecological environment, ensuring the production safety of agriculture and animal husbandry and the development and utilization of cloud and water resources in the air. Article 7 Where the development and utilization of cloud water resources in the air are used to carry out weather modification operations, the competent meteorological department of the autonomous region shall, in accordance with the relevant provisions of the state, analyze and evaluate the utilization potential, climate suitability, risk and possible impact on the local climate of cloud water resources in the air. Eighth county (city) above the competent meteorological departments shall, jointly with the development and reform, finance, agriculture and animal husbandry, forestry, water conservancy, environmental protection and other relevant departments. , the preparation of the administrative area of weather modification annual plan, submitted to the people's government at the same level for approval before implementation.
The capital construction funds, operational funds, operating funds and scientific research funds required for the implementation of the weather modification work plan are included in the fiscal budget at the corresponding level. Article 9 The competent meteorological departments of counties (cities) shall, according to the climatic characteristics and geographical conditions of their respective administrative areas, put forward the layout scheme of weather modification workplaces, which shall be submitted to the competent meteorological departments of autonomous regions jointly with the relevant flight control departments for determination after preliminary examination by the competent meteorological departments of the state and city (prefecture).
The determined weather modification operation site shall not be changed without authorization; If it is really necessary to change, it shall be handled in accordance with the provisions of the preceding paragraph. Tenth weather modification operation equipment warehouse, ammunition warehouse, launch platform and other facilities construction, shall comply with the relevant standards of the state and the autonomous region. Eleventh units engaged in weather modification operations (hereinafter referred to as operating units) shall have the qualifications of legal persons and meet the following conditions:
(1) The antiaircraft guns, rocket launchers and flare launchers in service meet the relevant mandatory technical standards of the state;
(2) The infrastructure such as gun depots and ammunition depots comply with relevant safety management regulations;
(three) commanders and operators must pass the training and examination by the competent meteorological departments of the autonomous region, and reach the required number;
(four) communication equipment to keep in touch with the weather modification operation command platform and flight control department. Twelfth units applying for weather modification operations shall apply to the competent meteorological departments of the state and city (prefecture) and submit the following materials:
(a) the organization code certificate of the unit legal person;
(two) certificate of operation equipment;
(3) Operator training and assessment certificate;
(4) Relevant safety management systems.
State, city (prefecture) competent meteorological departments shall, within 20 days from the date of receiving the application, put forward preliminary opinions and report them to the competent meteorological departments of the autonomous region for confirmation; The competent meteorological department of the autonomous region shall, within 20 days from the date of receiving the audit opinion, issue a certificate of identification of the weather modification operation unit to meet the conditions; Do not meet the conditions, not recognized, and explain the reasons to the applicant. Thirteenth in any of the following circumstances, the competent meteorological departments at or above the county (city) shall organize the operation units to carry out weather modification operations:
(1) There has been a drought, which is expected to get worse;
(two) there may be severe hail weather;
(3) Forest and grassland fires occur or forest and grassland are in a period of high fire risk for a long time;
(four) due to the serious shortage of water resources, the ecological environment has deteriorated;
(five) other circumstances that require the implementation of weather modification operations.
The joint implementation of weather modification operations across administrative regions shall be coordinated and organized by the competent meteorological department at the next higher level. Fourteenth the use of aircraft to carry out weather modification operations shall apply to the flight control department of the competent meteorological department of the autonomous region; Where anti-aircraft guns, rocket launchers and flame launchers are used to carry out weather modification operations, the competent meteorological department directly in charge of the operation unit shall apply to the flight control department. The contents of the application specified in the preceding paragraph shall include the name, code, latitude, longitude and height of the workplace, operator code, operation equipment and operation time limit. Article 15 The competent meteorological department of the autonomous region shall, in consultation with the relevant flight control departments and airport management agencies, coordinate and cooperate in airspace deployment, aircraft take-off and landing, standby and ground support to ensure the implementation of weather modification operations. Sixteenth weather modification operations using radar, radio and other equipment and frequency, directly responsible by the competent meteorological departments, operating units in accordance with the law to apply to the radio management agencies, reported to the competent meteorological departments of the autonomous region for the record.
Radio frequencies and channels used in weather modification operations are protected by law, and no unit or individual may occupy or interfere with them.
