Interim Provisions of Baicheng Municipality on Compensation and Resettlement for Housing Demolition in shantytown renovation

Article 1 In order to speed up the transformation of shanty towns in our city, improve the living environment of residents, and ensure the smooth progress of urban construction projects, these Provisions are formulated in accordance with the relevant provisions of the Regulations on the Administration of Urban Housing Demolition in the State Council, the Measures for the Administration of Urban Housing Demolition in Baicheng City and the transformation of shanty towns in the province, combined with the actual situation in our city.

Article 2 These Provisions shall apply to the house demolition in shanty towns determined by the municipal government on the state-owned land in the urban areas of our city, and give compensation and resettlement.

Article 3 The term "demolisher" as mentioned in these Provisions refers to the unit that has obtained the house demolition permit; The person being demolished refers to the owner of the house being demolished.

Fourth demolition compensation, can implement the exchange of housing property rights, can also implement monetary compensation.

Sixth people who choose monetary compensation, according to the following relevant provisions:

(five) the demolition shall bear the one-time relocation allowance for the demolition or the lessee, and the specific standards shall be implemented in accordance with the provisions of the Baicheng real estate market evaluation guidance price document published in the same year.

(six) the demolition can hold the shantytown renovation housing demolition compensation and resettlement agreement and the purchase contract exempt from deed tax, and only pay the housing ownership registration fee.

(five) the resettlement site is determined according to the design requirements stipulated by the relevant government departments.

(six) the demolition shall bear the relocation allowance of the demolition or lessee, and the specific standards shall be implemented in accordance with the provisions of the Baicheng real estate market evaluation guidance price document published in the same year.

(seven) ancillary facilities shall not be compensated.

Article 8 1 April 19901The houses built before the implementation of the Urban Planning Law of People's Republic of China (PRC) are demolished, and no house ownership certificate will be handled. Confirmed by the real estate ownership management department, the house owner (photo) who meets the requirements for accreditation will be resettled as a residential house after paying the relevant taxes and fees, with a certificate (photo).

Article 9 If the property right of the demolished person is changed, it shall be distributed according to the following principles: according to the sum of the serial number of the signed agreement and the moving serial number, the demolished person shall select the floors and room numbers in the corresponding apartment in the order from small to large, and publicize them.

Tenth relocation and distribution work should be carried out after the renovation and demolition of shanty towns and the design review of construction drawing expansion.

Twelfth to give reasonable compensation and care for low-income households in shanty towns. Low-income households refer to urban residents who enjoy the minimum living allowance in local cities with the approval of civil affairs and other relevant departments.

Article 13 Other provisions

(a) the temporary resettlement subsidies during the transition period must be paid quarterly according to the provisions of the Baicheng real estate market evaluation guidance price document published in the same year. If the relocation time exceeds the specified time, it shall be implemented in accordance with relevant policies.

(two) one household and two households living in certified houses (excluding certified mobile houses) are not divided into households; One room and two halls have no independent living conditions, and if there are two ownership certificates, they will be treated as one room; If you have the ownership certificate of * * * and cannot live independently, you will not be resettled independently. After the relocation, part of * * * will remain, or the owner and * * * will settle it in monetary terms.

(3) For long-term residence and expansion of temporary buildings with independent living conditions (bedroom, kitchen, electricity and water meter) or illegal buildings with an area of more than 15 square meters (including 15 square meters), if there is no housing in other places, they will be resettled as houses of 36 square meters, and they will pay the construction fee of 700 yuan per square meter and enjoy all property rights. The house shall not be listed and traded within 5 years from the date of relocation.

For extended temporary buildings or illegal buildings that have lived here for a long time, have no housing elsewhere, and do not have the above living conditions, they shall be placed in a house of 36 square meters, and each square meter shall pay a construction fee of 800 yuan, enjoying all property rights, and the house shall not be listed and traded within 5 years from the date of relocation.

The expansion of temporary buildings and illegal buildings that do not have the living conditions for renting, transferring and stacking sundries will not be compensated.

(4) If the children of the demolished or the lessee attend primary schools during the temporary transition period, they can hold the demolition agreement and the letter of introduction issued by the original school, and the district education administrative department will coordinate the primary schools in the temporary transition area to borrow.

(five) the same person can only enjoy a preferential policy of compensation and resettlement for shantytown renovation and demolition.

Fourteenth by the municipal administrative department of urban construction administrative ruling, the demolition or housing tenant refuses to perform the relocation obligations within the time limit stipulated in the ruling, the relevant departments shall implement administrative compulsory demolition or apply to the people's court for compulsory execution.

Fifteenth matters not covered in these Provisions shall be implemented in accordance with relevant laws and regulations and the "Measures for the Administration of Urban Housing Demolition in Baicheng City".

Article 16 Supervision and management
