Regulations of Jieyang Municipality on Safety Management of Fireworks and Firecrackers

(Adopted at the 39th meeting of the Standing Committee of the Sixth Jieyang Municipal People's Congress on October 27th, 2020, and approved at the 30th meeting of the Standing Committee of the 13th Guangdong Provincial People's Congress on March 28th, 2002/KLOC-0).

Article 1 In order to strengthen the safety management of fireworks and firecrackers, safeguard the public and personal and property safety, reduce air pollution and improve environmental quality, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution, the Regulations on the Safety Management of Fireworks and Firecrackers and other laws and regulations, and in light of the actual situation of this Municipality.

Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and related safety management activities within the administrative area of this Municipality.

Third people's governments at or above the county level shall strengthen the organization and leadership of the safety management of fireworks and firecrackers, and coordinate the major issues in the safety management of fireworks and firecrackers.

Township people's governments and sub-district offices shall, in accordance with their duties, strengthen supervision and inspection of the safety of fireworks and firecrackers in their respective jurisdictions, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of fireworks and firecrackers according to law.

Fourth public security organs are responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

Emergency management, fire rescue, ecological environment, urban management and comprehensive law enforcement, market supervision and management, housing and urban and rural construction, culture, tourism and sports, civil affairs, education, meteorology and other departments shall, according to their respective functions and duties, do a good job in the safety management of fireworks and firecrackers.

Fifth people's governments at all levels and their relevant departments should take various forms to strengthen the publicity of fireworks and firecrackers laws and regulations, and enhance the public's awareness of safe and civilized fireworks and firecrackers.

Schools, kindergartens and other educational institutions should strengthen the education of safe and civilized fireworks and firecrackers, and cultivate students' and minors' awareness of environmental protection and safety.

Radio, television, newspapers, internet and other mass media should strengthen the public welfare publicity on the safety of fireworks and firecrackers.

Encourage social organizations such as environmental protection and volunteers to participate in voluntary service activities that prohibit the discharge of fireworks and firecrackers.

Encourage the change of customs, advocate the use of electronic firecrackers, fireworks and other safe and environmentally friendly alternative products.

Sixth villagers' committees and residents' committees shall assist the people's governments at all levels and relevant departments to do a good job in the safety management of fireworks and firecrackers in their residential areas.

Encourage villagers' committees and residents' committees to promote the relevant contents of the safe discharge of fireworks and firecrackers into village regulations and residents' conventions, and guide villagers and residents to discharge fireworks and firecrackers legally, safely and civilly.

Article 7 Fireworks and firecrackers are prohibited in the following areas of this Municipality:

(1) Rongcheng administrative region;

(2) The jurisdiction of Quxi Street and Pandong Street in Jiedong District and the administrative area of Xichang;

(3) Urban built-up areas within the jurisdiction of Liusha East Street, Liusha West Street, Liusha South Street, Liusha North Street, Chiwei Street, Da Nanshan Street and Liaoyuan Street in Puning City;

(four) the urban built-up area within the jurisdiction of Hepo Street in Jiexi County;

(5) Urban built-up areas within the administrative areas of Huicheng Town, Huahu Town and Donglong Town of Huilai County;

(6) Jieyang Da Nanhai Petrochemical Industrial Zone Chemical Industrial Park;

(seven) other areas designated by the people's governments at or above the county level.

The specific scope of the urban built-up area mentioned in the preceding paragraph shall be delineated and promulgated by the local people's government at the county level.

Article 8 No unit or individual may set off fireworks and firecrackers in the following places outside the areas specified in Article 7 of these Regulations:

Office of state organs;

(two) cultural relics protection units, historical and cultural blocks, historical features, historical buildings protection scope;

(3) Transportation hubs such as stations, ports, docks and airports, safety protection zones of expressways and railway lines, bridges, tunnels and parking lots (garages);

(four) gas stations, oil depots and other units (places) that produce, manage and store flammable and explosive materials, and oil (gas) pipeline safety protection zones;

(5) Safety protection zones for power transmission and transformation facilities such as substations and high-voltage lines;

(six) medical institutions, pension institutions, kindergartens and schools;

(seven) forest, nursery and other key fire prevention areas and drinking water source protection areas;

(eight) shopping malls, bazaars and public cultural facilities, places for religious activities and other crowded places;

(nine) other places where the people's governments at or above the county level prohibit the discharge.

Where fireworks and firecrackers are prohibited, the owner, user or management unit shall set warning signs prohibiting fireworks and firecrackers and do a good job in protection.

Ninth in the following time, it is forbidden for any unit or individual to set off fireworks and firecrackers within the administrative area of this Municipality:

(a) the Municipal People's government issued a warning period for heavy pollution weather above yellow;

(2) during the senior high school entrance examination and college entrance examination;

(three) other times when the people's governments at or above the county level prohibit the discharge.

When the Municipal People's Government, relevant departments and news media release relevant information during the early warning period of heavily polluted weather above yellow and during the senior high school entrance examination and college entrance examination, they should remind the public that fireworks and firecrackers are prohibited during this period.

Article 10 The people's governments at or above the county level shall, in accordance with the provisions of Articles 7, 8 and 9 of these Regulations, delimit or stipulate other areas, places and times where fireworks and firecrackers need to be prohibited, conduct scientific argumentation, solicit public opinions extensively, determine them according to legal procedures, and announce them to the public.

Eleventh in areas and places where fireworks are prohibited, fireworks should comply with the relevant provisions of national standards on product grade and consumption category.

It is forbidden to set off fireworks and firecrackers without permission, and professional fireworks and firecrackers should be set off in accordance with national standards.

Twelfth in the seventh, eighth and ninth provisions of this Ordinance prohibit the discharge of fireworks and firecrackers in the region, place and time, should be in accordance with the discharge instructions, correct and safe discharge, and comply with the following provisions:

(a) not to pedestrians, vehicles, buildings (structures), public green spaces, rivers, crowded places, underground pipe networks and other throwing fireworks;

(two) shall not affect the road traffic safety;

(3) Fireworks and firecrackers shall not be put into inflammable and explosive articles;

(four) shall not be set off on the building (structure) or throw fireworks from the roof, balcony and window;

(five) shall not endanger public safety and personal and property safety by other means;

(six) shall not violate the provisions of other relevant laws and regulations.

Minors who set off fireworks and firecrackers shall be accompanied by guardians or other adults.

Thirteenth fireworks evening and other large-scale fireworks display activities, the organizer shall, in accordance with the provisions of hierarchical management, apply to the public security organs of the people's governments at or above the county level with jurisdiction, and go through the formalities of fireworks display license according to law.

When making a licensing decision, the public security organ shall announce to the public the time, place, type, specification and quantity of fireworks and firecrackers.

If it is really necessary to hold large-scale fireworks display activities such as fireworks evening in the area where fireworks and firecrackers are prohibited as stipulated in Article 7 of these regulations, it shall be approved by the Municipal People's Government; If it is really necessary to hold large-scale fireworks display activities such as fireworks evening in the area where fireworks and firecrackers are prohibited as determined by the people's government at the county level, it shall be approved by the people's government at the county level.

Article 14 Where fireworks and firecrackers are set off outside the area, place and time where fireworks and firecrackers are prohibited, the discharge units and individuals shall conduct on-site inspection after the discharge, put out the fire left by the discharge in time, and properly handle the discharge residue.

Article 15 Units and individuals engaged in wedding, funeral and festive services, and hotels and hotel operators undertaking banquet services shall inform consumers in advance of the relevant provisions prohibiting the discharge of fireworks and firecrackers.

Hotels and hoteliers should discourage illegal fireworks and firecrackers on the spot in their service areas; If it cannot be effectively dissuaded, it shall report to the public security organ in time.

Sixteenth any unit or individual has the right to dissuade or report to the public security organs acts in violation of the provisions of these regulations.

After receiving the report, the public security organ shall deal with it in a timely manner, and reward it according to law if it is verified.

Seventeenth in any of the following circumstances, the public security organ shall order it to stop the discharge and impose a fine of not less than one hundred yuan but not more than five hundred yuan; Constitute a violation of public security management, shall be punished according to law:

(a) in violation of the provisions of Article 7 and Article 8 of these regulations, fireworks and firecrackers are set off in areas or places where discharge is prohibited;

(two) in violation of the provisions of article ninth of these regulations, fireworks are set off at the time when it is forbidden to set off;

(three) in violation of the provisions of the twelfth paragraph of this Ordinance, do not comply with the provisions of safe discharge.

Eighteenth in violation of the provisions of article thirteenth of these regulations, without permission to hold fireworks and other large-scale fireworks display activities, the public security organ shall order it to stop the discharge, and impose a fine of not less than ten thousand yuan but not more than fifty thousand yuan on the responsible unit.

Nineteenth departments and their staff responsible for the safety management of fireworks and firecrackers have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

Illegal implementation of administrative licensing;

(two) do not accept, not timely verification report;

(three) do not investigate and deal with illegal fireworks;

(four) other acts of abuse of power, dereliction of duty, favoritism.

Twentieth acts in violation of the provisions of this Ordinance, laws and regulations have stipulated legal responsibility, from its provisions.

Article 21 These Regulations shall come into force on June 0, 20265438.
