Shaanxi high temperature subsidy standard
1, Shaanxi high temperature subsidy standard: 25 yuan every day.
(1) If the daily maximum temperature reaches above 40℃ (except for emergency treatment due to personal and property safety and public interests), the enterprise shall stop outdoor open-air operations on that day.
(2) When the daily maximum temperature reaches 37℃ or more and 40℃ or less, the enterprise shall arrange outdoor outdoor operations for workers for a total of no more than 6 hours, and the continuous operation time shall not exceed the national regulations, and outdoor outdoor operations shall not be arranged within 3 hours of the maximum temperature period.
(3) When the daily maximum temperature reaches above 35℃ and below 37℃, the enterprise shall implement the shift system, shorten the continuous working hours of workers by turns, and shall not arrange outdoor workers to work overtime.
(4) Strengthen the protection of female workers and underage workers. Enterprises shall not arrange pregnant female workers and underage workers to engage in outdoor open-air operations and workplace operations with temperatures above 33℃ during high temperature weather above 35℃.
(5) When an enterprise signs a collective contract or a special collective contract for labor protection in hot work and hot weather, it shall specify the relevant contents of labor protection in hot work and hot weather, and earnestly put the health and life safety of workers in the first place.
2. All kinds of enterprises arrange for workers to engage in outdoor open-air operations in hot weather above 35℃, and cannot take effective measures to reduce the workplace temperature to below 33℃ (excluding 33℃), they shall pay high-temperature allowance to workers, with the standard of 25 yuan per person per day, and the payment time is from June 1 day to September 30 every year. The high temperature allowance shall be borne by the unit where the laborer works, and shall be charged from the cost, included in the total wages of the enterprise, and not included in the minimum wage standard.
3. The cool drinks and essential medicines provided by the enterprise for preventing heatstroke and cooling the workers shall not offset the high temperature allowance.
4. Enterprises shall not stop working, shorten working hours and reduce or deduct the wages of workers due to high temperature weather.
5. If a worker suffers from heatstroke due to high-temperature operation or high-temperature weather operation and is diagnosed or identified as an occupational disease, the enterprise shall ensure the implementation of his industrial injury insurance benefits.
In addition, according to the "Management Measures for the Issuance of High Temperature Allowance", the employer shall issue high temperature allowance on a monthly basis, specify the specific items and amount in the salary list, and keep the record of high temperature allowance for at least two years. The employer shall bear the burden of proof for the situation that the workers engage in high-temperature operations and issue high-temperature allowances.
