Article 1 In order to protect public safety and personal and property safety, prevent and control environmental pollution, and strengthen the management of fireworks and firecrackers, in accordance with the "Law of the People's Republic of China on the Prevention and Control of Air Pollution" and "Fireworks and Firecrackers" These regulations are formulated based on the actual situation of this city and other laws and regulations such as the Safety Management Regulations.
Article 2: It is prohibited to set off fireworks and firecrackers and related supervision and management activities within the administrative area of this city, and these regulations shall apply.
Article 3 Within the administrative area of this city, it is prohibited to set off fireworks and firecrackers in the following areas:
(1) Beijing-Taiwan Expressway, Shihuang Expressway, Langcang (Beijing-Shanghai) in the central urban area Within the area enclosed by the expressway;
(2) Renqiu City, Hejian City, Botou City, Huanghua City, Suning County, Xian County, Wuqiao County, Dongguang County, Nanpi County, Qingxian County , Mengcun Hui Autonomous County, Yanshan County and Haixing County are the built-up areas where the county-level people's governments are located.
The people's governments at the municipal and county levels may delineate other areas within their respective jurisdictions that prohibit the setting off of fireworks and firecrackers other than those specified in the preceding paragraph, and announce them to the public.
Article 4 Within the administrative area of this city, it is prohibited to set off fireworks and firecrackers in the following locations:
(1) Offices of government agencies and public institutions;
(2) Cultural relics protection units, public cultural facilities;
(3) Transportation hubs such as stations, docks, and airports, highways, tunnels, viaducts, overpasses, rail transit facilities, and railway line safety protection zones ;
(4) Production and storage sites for flammable and explosive dangerous goods;
(5) Within the safety protection zone of power transmission and transformation facilities;
(6 ) Medical institutions, nursing homes, kindergartens, schools, welfare homes, and funeral homes;
(7) Forests, public green spaces and other key fire prevention areas, large and medium-sized reservoir management areas, and drinking water source protection areas;
(8) Shopping malls, markets, scenic spots, parks and other crowded places;
(9) Other locations specified by the municipal and county-level people's governments.
At the locations listed in the preceding paragraph, the people's governments at the municipal and county levels shall organize and set up unified warning signs prohibiting the setting off of fireworks and firecrackers, and provide safety reminders and precautions.
Article 5: During the heavy pollution weather warning period, this city implements emergency response measures such as prohibiting the setting off of fireworks and firecrackers in the entire region.
The Municipal People's Government shall, based on the heavy pollution weather warning level and in accordance with the prescribed procedures, timely activate the emergency plan, and release the heavy pollution weather warning information and the ban on setting off fireworks and firecrackers to the public through the media.
Article 6: Municipal and county-level people’s governments are responsible for overall planning and coordination of the ban on setting off fireworks and firecrackers.
The township (town) people's governments and sub-district offices should include the prohibition of setting off fireworks and firecrackers within the scope of comprehensive management of public security at the grassroots level, and strengthen organization, coordination, guidance and supervision.
People's governments at the municipal, county and township levels should include the relevant funds for prohibiting the setting off of fireworks and firecrackers in the fiscal budgets at the same level.
Article 7: The public security organs are responsible for the public security management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers in accordance with the law.
Emergency management, ecological environment, market supervision, urban management, administrative approval, civil affairs, meteorology, housing and construction, education and other departments should strengthen cooperation and linkage in accordance with their respective responsibilities, and jointly carry out fireworks and firecrackers discharge Control work.
Article 8: Municipal, county, and township-level people's governments and their relevant departments shall strengthen publicity and education on the prohibition of setting off fireworks and firecrackers.
Residents (village) committees, owners committees, and property service companies should assist relevant departments in the work related to prohibiting the setting off of fireworks and firecrackers, and strengthen publicity, education and guidance to residents (villages) and owners.
Governments, enterprises, institutions and other social organizations should carry out publicity and education on the prohibition of setting off fireworks and firecrackers in their own units and industries.
Media units such as radio, television, newspapers, and the Internet, as well as outdoor advertising operators and publishers, should carry out public welfare publicity and public opinion supervision on the prohibition of setting off fireworks and firecrackers.
Schools and guardians of minors should educate minors on the safety knowledge of fireworks and firecrackers and the prohibition of setting off fireworks and firecrackers.
Relevant social organizations and volunteers are encouraged to participate in volunteer service activities that prohibit the setting off of fireworks.
Advocate the use of safe, environmentally friendly alternatives to fireworks and firecrackers.
Article 9: To hold fireworks shows and other large-scale fireworks display activities, the organizer shall apply for a license to the public security organ in accordance with the regulations on hierarchical management. After obtaining a "Fireworks Discharge Permit" after review, the units and operators involved in fireworks shows and other large-scale fireworks display activities shall conduct discharge operations in accordance with the safety regulations for fireworks discharge and the approved discharge operation plan.
Article 10 In areas where the setting off of fireworks and firecrackers is prohibited, units and individuals that provide catering, accommodation, wedding ceremonies, and funeral services shall inform service recipients of the relevant regulations prohibiting the setting off of fireworks and firecrackers, and shall not provide services to set off fireworks on their behalf. Firecracker-related services are provided, and the behavior of setting off fireworks and firecrackers within their city appearance and environmental sanitation responsibility areas is discouraged; those who refuse to listen to the dissuasion must be reported to the public security organs in a timely manner.
Article 11: Any unit or individual has the right to report any illegal setting off of fireworks and firecrackers to the public security organs.
Public security organs should set up a special reporting hotline. After receiving reports, they should promptly investigate and handle them according to their responsibilities and authority or transfer them to relevant departments for processing.
If the reporting clues are found to be true after investigation, rewards shall be given. Specific measures shall be formulated by the people's governments at the municipal and county levels.
Article 12: If any unit or individual violates these regulations and is subject to administrative penalties, relevant information shall be disclosed to the public in accordance with the law.
Article 13 If the relevant administrative departments and their staff neglect their duties, abuse their powers, engage in malpractice for personal gain in the management of the prohibition of setting off fireworks and firecrackers, the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the law. Administrative sanctions; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
Article 14 Anyone who violates the provisions of Articles 3, 4 and 5 of these Regulations by setting off fireworks and firecrackers in areas, places or during periods where the setting off of fireworks and firecrackers is prohibited shall be ordered by the public security organ to stop setting off. A fine of not less than 100 yuan but not more than 500 yuan shall be imposed; if it constitutes a violation of public security management, public security management penalties shall be imposed in accordance with the law.
Article 15: Fireworks parties and other large-scale fireworks display activities are held without permission, or fireworks parties and other large-scale fireworks display activities are conducted by the operating units and operators in violation of the fireworks safety regulations and discharge operation plans. If such operations are carried out, the public security organs shall order them to stop setting off, and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan on the responsible unit.
Article 16: For violations of Article 10 of these Regulations, the public security organs shall impose a fine of not less than 200 yuan but not more than 500 yuan on units or individuals that fail to fulfill their obligations to inform, dissuade or report.
In violation of Article 10 of these Regulations, any unit or individual that provides catering, accommodation, wedding ceremonies, or funeral services in an area where fireworks and firecrackers are prohibited from setting off fireworks and firecrackers, and provides services related to setting off fireworks and firecrackers on their behalf, shall be ordered by the public security organ If correction is made, a fine of not less than 1,000 yuan but not more than 3,000 yuan will be imposed.
Article 17: If laws and regulations have provisions for penalties for violations of these provisions, such provisions shall prevail.
Anyone who violates these regulations and causes personal injury or property loss shall bear civil liability in accordance with the law; if it constitutes a violation of public security management, he shall be subject to public security management penalties in accordance with the law; if it constitutes a crime, he shall be investigated for criminal responsibility in accordance with the law.
Article 18: These regulations will come into effect on January 1, 2021.
