How to understand the completion date

Legal analysis: the completion date refers to the completion date of the construction project agreed in the contract. There are different opinions and disputes about the completion date in practice. Because the completion date is closely related to whether the construction period is in breach, the start time of the project payment and the interest-bearing time of the project payment, the two are closely related. At the end of the project, the completion date is related to salary, so it is very important to grasp the completion date accurately.

Regarding the determination of the completion date, it is stipulated in the model text of China's construction contract that the date when the project is completed and accepted and the contractor issues the completion acceptance report is the actual completion date. If the project passes the completion acceptance after modification according to the requirements of the Employer, the actual completion date shall be the date when the Contractor will submit the modification to the Employer for acceptance. If there is no agreement or unclear agreement in the construction contract, the statutory principle shall apply.

Legal basis: Article 14 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Laws in the Trial of Construction Contract Disputes.

(1) If the construction project has passed the completion acceptance, the completion acceptance date shall be the completion date;

(two) the contractor has submitted the completion acceptance report, and the employer delays the acceptance, and the date when the contractor submits the acceptance report is the completion date;

(three) the construction project has not been completed and accepted, and the employer uses it without authorization, and the date of transfer of possession of the construction project is the completion date.
