Measures of Ningbo Municipality on Labor Protection in Special Weather
State organs, institutions and social organizations shall, with reference to these measures, arrange the work of workers who have established labor relations with them during special weather. Article 3 The term "special weather" as mentioned in these Measures refers to high temperature, low temperature, typhoon, rainstorm, blizzard, road icing, strong convection, heavy atmospheric pollution and other weather that is not conducive to safe production.
The strong convective weather mentioned in the preceding paragraph includes heavy precipitation, thunderstorms, tornadoes and hail weather. Article 4 Labor protection in special weather adheres to the principles of people-oriented, safety first and prevention first. Article 5 The municipal and county (city) district people's governments shall strengthen their leadership over the work of labor protection in special weather, support and urge all relevant departments to perform their duties of supervision over production safety, and coordinate and solve major problems existing in the work of labor protection in special weather.
Safety production supervision and management, human resources and social security departments are responsible for the daily supervision and management of labor protection in special weather according to their respective responsibilities.
The departments of economy and informatization, housing and urban construction, water conservancy, transportation, urban management, ocean and fishery shall, according to their respective functions and duties, supervise and inspect the labor protection in special weather in related industries and fields.
Departments of health, environmental protection, meteorology, culture, broadcasting, press and publication shall, in accordance with their respective responsibilities, cooperate to do a good job in labor protection in special weather. Article 6 This Municipality implements a system of real-time monitoring, early warning and forecasting of special weather.
City and county (city) people's governments shall organize competent meteorological departments and relevant departments to establish and improve the meteorological disaster early warning information platform. Meteorological offices and stations affiliated to the competent meteorological departments, meteorological offices and stations affiliated to other relevant departments and other units related to special weather monitoring and forecasting shall provide meteorological monitoring information to the meteorological disaster early warning information platform in a timely and accurate manner. Relevant departments and units shall share information.
Meteorological offices and stations subordinate to the competent meteorological departments (hereinafter referred to as meteorological offices and stations) shall issue special weather warning information in accordance with their duties. Seventh television, radio, newspapers, Internet, telecommunications and other media should broadcast or publish special weather and meteorological information and early warning and forecast provided by meteorological stations to the public in a timely manner.
When broadcasting or releasing meteorological information and special weather warning and forecasting, the relevant units shall not delete meteorological information and various special weather warning and forecasting information.
Employers and workers should pay attention to listening, watching and inquiring the latest special weather warning information, understand the meaning and requirements of the warning signal, and enhance their awareness and ability to prevent it. Chapter II Service and Supervision Article 8 The Municipal People's Government shall establish a catastrophe insurance system. Workers who suffer personal injury or death during special weather and meet the conditions of public catastrophe insurance can get corresponding insurance money. Ninth county (city) District People's government can take encouraging measures to commend and reward the employing units that have made remarkable achievements in the work of labor protection in special weather. Article 10 An employing unit that has suffered heavy economic losses due to special weather may apply to the county (city) District People's Government for deferment, reduction or exemption of relevant administrative fees and other assistance in accordance with relevant regulations. Article 11 The departments responsible for the supervision and administration of production safety in industries and fields in cities and counties shall, in accordance with the provisions of laws and regulations on production safety, strengthen publicity and education on the labor protection work of employers in special weather, and guide employers in their industries and fields to do a good job in labor protection work in special weather.
Encourage associations to provide employers with services such as information, training, emergency plan formulation and emergency drills on labor protection in special weather according to laws, regulations and articles of association. Article 12 The municipal, county (city) departments of production safety supervision and management, human resources and social security, health, meteorology and environmental protection, as well as the departments responsible for the supervision and management of production safety in the industrial field, shall provide the employing units with education and training on labor protection safety in special weather and take labor protection measures to provide technical support. Thirteenth city and county (city) district safety production supervision and management departments, human resources and social security departments and other departments in charge of relevant industries and fields responsible for safety production supervision and management should strengthen the supervision and management of the employer to implement labor protection measures in special weather. The relevant departments should take the initiative to listen to the opinions of trade unions, representatives of employers and laborers when implementing supervision and management. Fourteenth city and county (city) district safety production supervision and management departments, human resources and social security departments and other departments in charge of industries and fields responsible for safety production supervision and management shall establish and improve the complaint reporting system, and openly accept complaints and reports to the public.
After receiving complaints and reports, the relevant departments shall accept and investigate the matters within the scope of their duties within 5 working days, and feed back the investigation results to the parties; Matters that do not fall within the scope of responsibilities of this department shall be transferred to relevant departments within 3 working days, and the parties concerned shall be informed.
