Article 2 These Regulations shall be observed when engaging in meteorological detection, forecasting, services, meteorological disaster prevention, climate resource utilization and other activities within the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China. Article 3 The state implements a system that combines unified leadership with hierarchical and departmental management of meteorological work.

The agency authorized by the State Council to be in charge of national meteorological work (hereinafter referred to as the meteorological agency of the State Council) is in charge of national meteorological work. The meteorological authorities of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for meteorological work within their respective administrative regions. Local meteorological authorities at all levels implement a management system in which the superior meteorological authority and the people's government at the same level have dual leadership, with the upper-level meteorological authority as the main leader.

Other departments under the State Council that have meteorological work agencies are responsible for managing the meteorological work of their own departments in accordance with the division of labor, and are subject to the industry management of the meteorological authority of the State Council. Article 4 People's governments at all levels should strengthen leadership over meteorological work and support the construction of meteorological infrastructure. Local people's governments at or above the county level may, in accordance with the layout principles of the national meteorological modernization construction and the needs of local social and economic development, construct local meteorological undertaking projects that mainly serve local economic construction, and the required capital construction investment and related undertaking funds shall be included in the National economic and social development plans and fiscal budgets at this level. Article 5 If meteorological services fall within the scope of meteorological public welfare services, they shall be provided free of charge; if they fall within the scope of professional meteorological services, they may be provided for a fee. Article 6 The state encourages citizens, legal persons and other organizations to engage in research activities on meteorological detection and weather forecasting technology in accordance with the provisions of these regulations, and their legitimate rights and interests are protected by the state. Article 7 Foreign organizations or individuals that engage in relevant meteorological activities in the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China must obtain approval from the meteorological administrative agency of the State Council in conjunction with the relevant competent departments, and comply with the provisions of the People's Republic of China. Chapter 2 Meteorological Detection Article 8 The layout of the national meteorological observatory network shall be unifiedly planned by the meteorological administrative agency of the State Council. Article 9 The detection sites, instruments, facilities, signs and meteorological communication circuits, channels and facilities of meteorological stations are protected by the state, and no unit or individual may move or damage them without authorization. Article 10 It is prohibited to carry out engineering construction or other activities that have an adverse impact on meteorological detection within the protection scope of the meteorological detection environment; if such activities need to be carried out due to special circumstances, the consent of the competent meteorological agency must be obtained.

The protection measures and management methods for the meteorological detection environment shall be formulated by the meteorological authority of the State Council in conjunction with the relevant competent departments of the State Council. Article 11 The location of meteorological stations and the placement of their facilities shall remain stable for a long time. The state implements classification, hierarchical protection and management of the detection sites, facilities and environmental conditions of meteorological stations. If general meteorological stations or their facilities must be relocated due to the needs of project construction or urban planning, the construction unit must report to the provincial, autonomous region, or municipality meteorological authorities for approval one year in advance; if it is really necessary to relocate national benchmark climate stations or basic meteorological stations, the construction unit must Units must report to the meteorological authority of the State Council for approval two years in advance. The costs required to relocate and rebuild meteorological stations or their facilities shall be borne by the construction unit. Article 12 When the detection environment of a meteorological station or its facilities are damaged by natural disasters or wars, the local people's government shall take emergency measures and organize efforts to repair them to ensure the normal conduct of meteorological work. Article 13 Foreign organizations or individuals carry out meteorological detection in the territory of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China alone or in cooperation with relevant departments and individuals of the People's Republic of China. The data obtained belongs to the People's Republic of China; the provider of the detection data has the right to use the data. Chapter 3 Forecasts and Warnings Article 14 The state implements a unified issuance system for meteorological forecasts and severe weather warnings.

Meteorological forecasts and severe weather warnings are publicly released by meteorological stations at all levels affiliated to the meteorological authority of the State Council in accordance with their duties. Other organizations and individuals are not allowed to release them to the public through publicity media. The issuance methods for meteorological forecasts and severe weather warnings shall be formulated by the meteorological authority of the State Council.

Meteorological stations affiliated to other relevant departments of the State Council may issue professional weather forecasts to their own departments. In remote areas where national meteorological stations are sparse, with the consent of the meteorological authorities of provinces, autonomous regions, and municipalities directly under the Central Government, they may also issue professional weather forecasts to relevant local agencies. Article 15 Meteorological stations at all levels affiliated to the meteorological administrative agency of the State Council shall timely and accurately prepare and issue weather forecasts and disastrous weather warnings based on the needs of local economic construction and disaster prevention and reduction, and timely issue supplementary warnings based on weather changes. or revised forecasts and warnings. Article 16 Posts and telecommunications departments at all levels shall, in accordance with relevant national regulations, cooperate closely with meteorological agencies at the same level to ensure smooth meteorological communications and quickly and accurately complete the transmission of meteorological information, weather forecasts and disastrous weather warnings.
