Overtime is paid, and the national overtime standards are as follows:
1. During the legal holidays, if the employer arranges the laborers to work, it shall pay them wages not less than 300% of the laborers' wages, and it shall not be replaced by compensatory time off or compensatory time off;
2. If workers are arranged to work on rest days but can't arrange compensatory time off or compensatory time off, they shall be paid no less than 200% of the workers' wages. If the unit fails to provide employees with adjustment or compensatory time off, employees have the right to demand double wages;

It is illegal for employers to ask employees to work overtime without paying overtime. If the amount of wages is clearly stipulated in the labor contract, the wages agreed in the labor contract shall be used as the basis for calculating overtime wages. It should be noted that if the salary items in the labor contract are divided into "basic salary", "post salary" and "post salary", etc. Overtime wages should be calculated by the sum of all wages, not by "basic salary", "post salary" or "post salary" alone.
If the amount of salary is not clearly stipulated in the labor contract, or the contract is not clear, the actual salary shall be taken as the calculation base. All wages, bonuses, allowances and subsidies paid directly to employees by employers belong to actual wages and are several components of the "total wages" stipulated by Chinese laws. When the actual wages can be used as the calculation base of overtime wages, overtime wages, food subsidies and labor protection subsidies should be deducted and cannot be included in the calculation range.

Article 44 Under any of the following circumstances, the employing unit shall pay wages higher than the wages of the workers during their normal working hours according to the following standards:
(1) If the laborer is arranged to work longer hours, he shall be paid no less than 150% of the salary;
(2) If workers are arranged to work on rest days but cannot be arranged for compensatory time off, they shall be paid a salary of not less than 200% of their wages;
(3) If workers are arranged to work on legal holidays, they shall be paid no less than 300% of their wages.
