Regulations of Hefei Municipality on the Protection of Urban Drinking Water Sources

Chapter I General Provisions Article 1 In order to strengthen the protection of urban drinking water sources, prevent water pollution, and ensure the safety and health of residents' drinking water, these Regulations are formulated in accordance with the provisions of the Water Pollution Prevention Law of People's Republic of China (PRC), the Water Pollution Law of People's Republic of China (PRC) and the Regulations on Environmental Protection of Urban Drinking Water Sources of Anhui Province, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection of drinking water sources within the urban planning area of this Municipality. ?

Drinking water sources mentioned in these Regulations include surface drinking water sources and underground drinking water sources. ? Article 3 Dongpu Reservoir, Dafangying Reservoir, their diversion channels and rivers are the key protected drinking water sources in Hefei.

Chaohu Lake is a strategic standby drinking water source in Hefei. Chaohu Lake water source protection, according to the "Chaohu Lake Basin Water Pollution Prevention Ordinance" implementation. ?

According to the actual needs of urban development, the Municipal People's Government may determine new water source protection sites and protect them with reference to these regulations. Article 4 The municipal water administrative department shall be responsible for the unified management and supervision of urban drinking water resources, and plan, allocate and monitor the water quality of urban drinking water resources. The municipal environmental protection administrative department is responsible for the unified supervision and management of environmental protection of urban drinking water sources.

Construction, land resources, planning, health, transportation, public security, agriculture, forestry, city appearance, industry and commerce, animal husbandry and aquatic products and other administrative departments shall, according to their respective functions and duties, coordinate in the protection of drinking water sources. ? Article 5 The Municipal People's Government shall incorporate the protection and management of drinking water sources into the national economic and social development plan and take measures to promote the protection of drinking water sources. ?

County (District), township (town) people's governments and sub-district offices shall strengthen management according to law and assist in the protection of drinking water sources. Article 6 All units and individuals have the obligation to protect drinking water sources from pollution, and have the right to stop, report and accuse acts of polluting and destroying drinking water sources. ? Seventh units and individuals that have made remarkable achievements and contributions to the protection of drinking water sources shall be commended and rewarded by the Municipal People's Government. Chapter II Delimitation of Drinking Water Source Protection Zones Article 8 According to the requirements of water source protection and management, drinking water source protection zones shall be established. ? Ninth Dongpu Reservoir and Dafangying Reservoir surface water source protection areas are divided into:

(1) First-class protected area: the reservoir area below the relocation line of immigrant houses in the flooded area around the reservoir (Dongpu Reservoir is an amphibious area below 30m elevation, and Dafangying Reservoir is an amphibious area below 29.7m elevation); ?

(2) Secondary protected areas: the area extending 1 1,000 meters from the primary protected area, and other reservoirs in the watershed of key drinking water source protection areas;

(3) Third-level protected area: The second-level protected area has a watershed where foreign exchange water enters the reservoir. ? Tenth drinking water diversion channels, river surface water source protection areas for channels, rivers upstream line on both sides of the extension of 50 meters. ? Eleventh drinking water underground source protection areas are delineated as follows:

(1) First-class protected area: centering on the water intake well, within a radius of 30 meters;

(2) Secondary protected area: the water intake well is the center, with a radius of 30 meters away and the water level obviously drops within 60 meters of the funnel area;

(3) Quasi-protected area: the main recharge area outside the secondary protected area. ? Article 12 The municipal water administrative department shall, jointly with the municipal environmental protection administrative department, delineate clear geographical boundaries of drinking water source protection areas, set up warning signs, and set up protective nets in key areas within the first-class surface water source protection areas of drinking water. Chapter III Protection of Drinking Water Sources Article 13 The water quality of the first-class and second-class protected areas of drinking water surface sources shall comply with the second-class and third-class standards in the national environmental quality standards for surface water. ?

The water quality of the drinking water underground source protection area shall meet the Class II standard of the national groundwater quality standard. ? Fourteenth municipal water administrative departments should take measures to maintain ecological balance and improve the self-purification ability of water bodies in Dongpu Reservoir and Dafangying Reservoir. ? Fifteenth in the drinking water surface water source protection zone, prohibit the following acts:

(a) set up sewage outlets, directly or indirectly discharge sewage and waste liquid into water bodies, and dump garbage, muck and other solid wastes; ?

(2) stacking and storing garbage, muck and other wastes on beaches and bank slopes; ?

(three) water swimming, water training and other water sports and entertainment activities; ?

(4) setting up livestock and poultry farms or stocking livestock and poultry in water bodies; ?

(five) cleaning vehicles and other appliances in the water or near the water source; ?

(six) poisonous fish, fried fish, electric fish and hunting waterfowl;

(seven) camping, picnic and other activities that pollute the water quality; ?

(8) Launching vessels other than special vessels for water administration supervision, hydrology, water quality monitoring and reservoir management;

(nine) cage culture around ponds, farmland and reservoirs; ?

(ten) set up commercial, catering and service outlets; ?

(eleven) crossing and destroying the protective net; ?

(twelve) new construction, expansion and water supply facilities and protection of water sources have nothing to do with the construction project; ?

(thirteen) other acts of water pollution as prescribed by laws and regulations. ? Sixteenth in the drinking water, surface water and water two protected areas, prohibit the following acts:

(1) The pollutants discharged by the built projects exceed the national or local pollutant discharge standards; ?

(two) renovation projects, not in accordance with the principle of total pollutant emission control to reduce pollutant emissions; ?

(three) new construction and expansion of construction projects that discharge pollutants into water bodies; ?

(4) establishing livestock and poultry farms; ?

(five) the construction project without the consent of the municipal environmental protection administrative department, without the approval of the municipal planning administrative department;

(six) stacking or operating waste residue, and setting up warehouses or stacks of hazardous chemicals. ?
