Provisions of Jilin Province on Climate Feasibility Demonstration

Article 1 In order to strengthen the management of climate feasibility demonstration, standardize the activities of climate feasibility demonstration, and avoid or mitigate meteorological disasters, adverse climatic factors and possible adverse effects on the local climate that may occur after the implementation of planned construction projects, these Provisions are formulated in accordance with the provisions of the Meteorological Law of People's Republic of China (PRC), the Regulations on the Prevention of Meteorological Disasters and other laws and regulations, combined with the actual situation of this province. Article 2 The term "climate feasibility demonstration" as mentioned in these Provisions refers to the activities of analyzing and evaluating the climate suitability, meteorological disaster risk and possible impact on the local climate after the implementation of planned construction projects closely related to climatic conditions. Third in the administrative area of this province to carry out climate feasibility demonstration activities, shall abide by these provisions. Article 4 The competent meteorological departments at or above the county level shall, under the leadership of the competent meteorological departments at higher levels and the people's governments at the corresponding levels, be responsible for the organization and management of climate feasibility demonstration within their respective administrative areas.

Other relevant departments and units shall cooperate with the competent meteorological departments to do a good job in climate feasibility demonstration. Article 5 Urban planning, national key construction projects, major regional economic development projects, large-scale projects for the development and utilization of climatic resources such as solar energy and wind energy, and nuclear and chemical projects closely related to climatic conditions shall be organized by the competent meteorological departments for climate feasibility demonstration.

The scope of the climate feasibility demonstration project shall be determined by the competent meteorological departments at or above the county level in conjunction with the relevant departments of development and reform, housing and urban and rural construction, transportation and so on. Article 6 The concrete implementation of climate feasibility demonstration shall be undertaken by institutions that meet the requirements stipulated by the competent meteorological department of the State Council and have the corresponding demonstration ability (hereinafter referred to as demonstration institutions).

When conducting climate feasibility demonstration, the demonstration institution shall prepare a climate feasibility demonstration report, ensure the authenticity, scientificity and foresight of the report, and be responsible for the conclusion of the demonstration. Seventh demonstration institutions shall conduct climate feasibility demonstration according to the needs of local government planning projects and the entrustment of project construction units.

The demonstration institution shall complete the demonstration work within 20 working days according to the needs of local government planning projects or from the date of accepting the entrustment. If the demonstration cannot be completed within 20 working days due to the need for on-site meteorological observation, the time limit for completing the demonstration shall be determined by the demonstration institution according to the time required for on-site meteorological observation. Eighth demonstration institutions shall use the meteorological data directly provided by the provincial competent meteorological department or approved by the provincial competent meteorological department for climate feasibility demonstration.

Where on-site meteorological observation is necessary, it shall be carried out in accordance with the relevant national laws, regulations, standards and norms on meteorological observation. The meteorological data obtained shall be submitted to the provincial competent meteorological department in real time, and can only be used after being examined and approved by the provincial competent meteorological department, and shall abide by the provisions of national security and state secrecy. Article 9 The technical methods for climate feasibility demonstration and preparation of demonstration report shall conform to national, industrial and local standards and relevant technical and business norms. Tenth climate feasibility report shall include the following contents:

(a) the general situation of planning or construction projects;

(two) the source of meteorological basic data and its representativeness and reliability. The information obtained through on-site testing should also explain the testing instruments, testing methods and testing environment;

(three) the standards, norms and methods on which the climate feasibility demonstration is based;

(4) Risk assessment of one or more extreme meteorological disasters such as rainstorm, blizzard, road ice and snow, gale, cold wave, thunder and lightning, hail, fog, high temperature, drought, sand dust (haze, sand blowing, floating dust, sandstorm), severe cold, frost, chilling injury and typhoon, and measures and methods to avoid or mitigate meteorological disasters;

(five) the analysis of the climate background, the probability analysis of extreme weather and climate events and the evaluation of climate suitability in the area where the planning or construction project is located;

(six) analysis, prediction and evaluation of the possible impact of planning or construction projects on the local climate;

(seven) planning or construction projects to deal with climate change, prevention or mitigation of the impact of countermeasures and suggestions;

(eight) the conclusion of the argument and the explanation of its applicability;

(9) Other relevant contents. Eleventh competent meteorological departments at or above the county level shall organize an expert review group to review the climate feasibility report of the planning or construction project within 15 working days, and issue a written review opinion. Twelfth overseas organizations, institutions and individuals engaged in climate feasibility demonstration activities within the administrative region of this province shall cooperate with the demonstration institutions confirmed by the competent meteorological department of the State Council and approved by the competent meteorological department of the State Council.

Overseas organizations, institutions and individuals that are approved to engage in climate feasibility demonstration activities within the administrative region of this province shall file with the provincial meteorological authorities and accept supervision and management. Thirteenth in the climate feasibility study, in any of the following circumstances, the competent meteorological departments at or above the county level shall order it to make corrections within a time limit and give a warning; If no correction is made within the time limit, a fine of 1000 yuan or more and 1000 yuan or less shall be imposed; If the circumstances are serious, a fine of 6,543,800 yuan and 30,000 yuan shall be imposed; If losses are caused, it shall be liable for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Prohibit the use of meteorological data and false demonstration reports involved;

(1) Using meteorological data beyond the requirements of these Provisions;

(2) Forging meteorological data or other original data;

(three) issued a false report;

(four) alter or forge the written evaluation opinions of the climate feasibility report.
