Do apprentices need five days' salary?
With regard to the apprenticeship and probation period, according to the "Reply of the General Office of the Ministry of Labor on Asking for Instructions on Issues Related to Labor and Employment Management", apprenticeship is a training method for newly recruited workers to get familiar with business and improve their work skills. After the implementation of the labor contract system, we should continue to adopt this training method and implement it within the time limit stipulated by the technical grade standard. The probation period is an investigation period of no more than six months agreed by the employer and the employee for mutual understanding and choice after establishing labor relations. The probation period and the apprenticeship period are included in the term of the labor contract and can be agreed at the same time, but the probation period shall not exceed half a year.
Probation period is a system for business adaptation and assessment of fresh graduates, not a concept under the labor contract system, but a practice under the personnel system. The official reply of the General Office of the Ministry of Labor "Request for Instructions on Issues Related to Labor and Employment Management" stipulates that the graduates of colleges, technical schools and technical schools newly assigned to work in the employing units shall still implement the one-year probation system according to the original provisions, and a probation period of no more than half a year may be agreed during the probation period. With the change of graduation distribution system and enterprise employment system, probation system is rare in practice and will gradually withdraw from the historical stage.
Legal basis: Article 36 of the Labor Law The state practices a working-hour system in which the working hours of laborers do not exceed eight hours per day and the average working hours per week do not exceed forty-four hours. Forty-sixth wage distribution should follow the principle of distribution according to work and implement equal pay for equal work. The wage level is gradually increased on the basis of economic development. The state exercises macro-control over the total wages. Article 47 The employing unit shall independently determine the wage distribution mode and wage level of the unit according to its production and operation characteristics and economic benefits. Article 48 The State implements the minimum wage guarantee system. The specific standard of the minimum wage shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the State Council for the record. The wages paid by the employer to the workers shall not be lower than the local minimum wage.
